The NURSE Visa Act: A Proposed 20,000 New Nurse Visas for Shortage-Area Hospitals

New legislation introduced in the House of Representatives could temporarily expand visa options for international nurses and potentially provide a faster pathway to address workforce shortages.

On February 4, 2026, Representative Don Beyer introduced the National Urgent Recruitment for Skilled Employees (NURSE) Visa Act of 2025. The bill would create 20,000 new temporary work visas each year for nurses working in areas where the federal government has identified a nursing shortage.

While the bill has been introduced and is not yet law, it represents another potential tool to strengthen the U.S. nursing workforce.

What the NURSE Visa Act Would Do

The legislation would reinstate and expand the H-1C visa program , a temporary visa category originally created in 1999 to address nurse shortages, which expired in 2009.

If enacted, the bill would:

Increase the Annual Visa Cap: Raise the limit from 500 visas under the previous program to 20,000 H-1C visas per fiscal year.

Limit Eligibility to Designated Shortage Areas: Restrict participation to facilities located in regions identified by the Health Resources and Services Administration (HRSA) as having nursing workforce shortages.
Eligibility is based on federal designation and is not limited to rural hospitals.

Require Staffing Ratio Policies: Require participating hospitals to maintain provider-to-patient staffing ratio policies.

Provide Temporary Work Authorization: Allow nurses to work in the U.S. for up to three years (not extendable beyond that period)

*It’s important to note that this visa is different from the H-1B visa. The proposal does not include the $100,000 employer fee currently associated with certain H-1B filings.

H-1C and EB-3: How They Compare

Today, most international nurses come to the United States through the EB-3 immigrant visa process, which provides permanent residency. EB-3 offers a long-term solution, but timelines can be extended due to visa backlogs and country caps.

The proposed H-1C visa, by contrast, would be a temporary work visa designed specifically for registered nurses in federally designated shortage areas. Here is how the two pathways differ:

The U.S. government introduced two separate visa actions in early 2026. The first, tied to national security concerns, paused immigrant visa issuance for certain countries starting Jan. 1, 2026, with limited exceptions.

The second action, which took effect Jan. 21, 2026, paused immigrant visa issuance for additional countries while the government reviews policies related to public benefits usage. In many cases, applicants may still attend embassy interviews, but immigrant visas are not being issued during the pause.

At the same time, U.S. Citizenship and Immigration Services (USCIS) has temporarily paused processing some immigration benefit applications for individuals from designated countries. These cases are on hold while guidance is reviewed and updated.

If those cases are temporarily removed from visa queues, nurses from countries not impacted by the pauses may see faster movement in employment-based visa processing.

“There may be some improvement in processing times for nurses from non-impacted countries,” Johnson-Lewis said. “However, the overall need for international nurses remains strong, and these pauses do not solve the long-term workforce shortage.”

The company noted that employment-based immigration already includes strong safeguards. These include background checks, police clearances, wage requirements and proof that employers can pay clinicians fairly. As the guidance is temporary and may change, WorldWide HealthStaff Solutions will continue supporting clinicians who are already in process from impacted countries. Who Must Pay the $100,000 Fee

The $100,000 fee applies to new H-1B petitions filed on or after 12:01 a.m. EDT, Sept. 21, 2025, for beneficiaries who:

Are outside the U.S. and do not hold a valid H-1B visa;
Are inside the U.S., but the petition requests consular notification, port of entry notification, or pre-flight inspection [as opposed to a request for a change of status, extension or amendment within the U.S.]; or
Are inside the U.S. and the petition requests a change of status within the U.S. but was approved by USCIS with a determination that the alien is ineligible for a change of status or an amendment or extension of stay.

Who Is Exempt

The $100,000 fee does not apply to:

Any currently valid H-1B visa holders;
Petitions submitted before 12:01 a.m. EDT on Sept. 21, 2025;
Petitions filed on or after Sept. 21, 2025, requesting an amendment, change of status, or extension of stay for someone already inside the U.S. (and approved accordingly by USCIS);
Beneficiaries who later depart and re-enter the U.S. based on a valid, approved H-1B petition.

Travel Guidance

The proclamation does not restrict travel for current H-1B visa holders or approved beneficiaries. However, candidates from countries under current travel bans or visa restrictions should exercise caution when leaving the U.S. and are strongly advised not to travel without first consulting an immigration expert.

How to Pay the $100,000 Fee:

For petitions subject to the fee:

Payment must be submitted through Pay.gov .
Payment must be made before filing the petition with USCIS.
At the time of filing, petitioners must provide:
Proof of payment scheduled through Pay.gov, or
Evidence of an approved exception from the Secretary of Homeland Security.

Petitions filed without either proof of payment or evidence of an exception will be denied.

How to Apply for an Exception

Exceptions will be granted only in extraordinarily rare cases, when the Secretary of Homeland Security determines that:

The beneficiary’s presence in the U.S. is in the national interest;
No U.S. worker is available to fill the role;
The worker poses no threat to U.S. security or welfare; and
Requiring the payment would significantly undermine U.S. interests.

The U.S. healthcare system is facing a workforce crisis. The American Hospital Association projects a shortage of 100,000 critical healthcare workers by 2028 . Rural communities are particularly vulnerable, with only about 30 physicians per 100,000 residents compared to 263 in urban areas. Nurses face similar gaps, with rural areas averaging 64 registered nurses per 10,000 people compared to 97 in urban areas.

For some hospitals and healthcare systems, these shortages have directly contributed to delayed care, overextended staff, and limited patient access.

What the Healthcare Workforce Resilience Act Would Do

Reintroduced by Senators Kevin Cramer (R-ND) and Dick Durbin (D-IL), the bipartisan Healthcare Workforce Resilience Act aims to ease these challenges and strengthen the healthcare workforce in the U.S. by using resources that already exist.

The bill would:

Recapture up to 40,000 previously authorized but unused green cards (25,000 for nurses and 15,000 for physicians).
Include family members of eligible healthcare professionals, who would be entitled to accompanying visas. These dependent visas are separate and do not count against the 25,000 nurse or 15,000 physician visas being recaptured under the bill.
Exempt these visas from per-country caps , ensuring applicants from high-demand countries are not stuck in disproportionate backlogs.
Require employers to attest that hiring international healthcare professionals will not displace U.S. workers but instead provide needed support.
Mandate licensing, background checks, and filing fees to ensure only qualified, vetted professionals receive visas.
Require expedited transfer of approved petitions between U.S. Citizenship and Immigration Services and the State Department to minimize delays.

Importantly, this legislation does not add new visas, it reallocates unused ones.

Understanding Visa Processing Times

‘How long will it take?’ is the most common question that employers contemplating international recruitment ask. ‘How long will it take?’ is also the top of mind question asked by applicants. The honest answer is ‘it depends.’

The U.S. employment based permanent residency program is the visa category in which the vast majority of RN applications are filed. There is an annual quota of these types of visas that are available for issuance each year. When the number of visas available in a current fiscal year is greater than the number of visa applications filed for processing, visas can be issued as quickly as 9-12 months. However, when the number of visa applications filed exceeds the number of visas available in the current fiscal period, processing times become extended. The industry term used to describe this condition is Retrogression. When the annual quota has been reached, those with remaining visa applications wait for their visas to be issued until the next government fiscal period when a new annual allotment of visas is made available.

It is also very important to note that there is never a limit on filing new visa applications regardless of the number of visa applications currently pending being less or more than the number of available visas in a current fiscal period.

While the answer to how long the visa process will take is ‘it depends’ that are a number of known factors that help to inform this question:

U.S. healthcare providers are very well aware of the pernicious shortage of RNs that has existed in varying degrees for decades. Today, the U.S. is graduating more RNs that ever before and yet the nursing headcount shortage lingers and, in some locations, getting worse. The reasons for this shortage are well documented across a wide body of academic research – essentially what employers are dealing with is a supply & demand imbalance in the workforce in that systemically there are more open positions than there are qualified applicants to fill them.

More recently a second type of nursing shortage is emerging that is proving to be as difficult or more difficult than the headcount shortage. This shortage relates to the growing shortage of experience.

As the number of new graduates has increased at the same time as the number of experienced RNs are leaving the workforce for various reasons, healthcare providers are seeing their RN workforce become increasingly novice. Noted workforce researcher Dr. Peter Buerhaus refers to this phenomenon as the ‘Experience – Complexity Gap’. Dr. Buerhaus’ research concluded that the US RN workforce force is losing about 2-million-person years of experience annually. This research concludes that by 2030 the U.S. RN workforce will have 20-million-person years of experience less than in 202. This is the direct result of experienced nurses being increasingly being replaced by those very much at the front end of their careers. Employers are having to provide more complex care with an increasingly novice workforce resulting in an Experience – Complexity gap. The good news is that there is a strategy that U.S. employers can implement now that will combat both types of the nursing shortage.
